A Will can do so many things but sometimes it takes a Trust to give your estate the true protection it needs.

A Trust protects against many things:

  • It prevents your bloodline losing out in the event of your dying and your surviving partner re-marrying. If you simply leave your estate to your partner and they re-marry and subsequently die, it is common for the estate your partner inherited from you to pass to the family of the new partner. A Trust prevents that from happening.
  • A Trust can mean that an inheritance left to a child who is facing problems can be distributed to that child in such a way that it won’t be squandered or misused.
  • In Scotland, children, spouses and civil partners have something called Legal Rights. This means that it is very difficult to disinherit a child, spouse or Civil Partner. The wishes expressed in a Trust are not subject to Legal Rights and therefore you can leave your estate to whomever you wish.
  • A child with disabilities could lose benefits if they inherit from you through a Will. Inheriting through a Trust means that entitlement to benefits is not affected.
  • A Trust gives powers to Trustees which can be useful if you become incapable. This can enhance a Power of Attorney.
  • Assets in a Trust can be distributed immediately – no need to go through Executry or Probate.
  • Because of this a Trust effectively pays for itself. Because any assets in a Trust do not need to go through the Executry or Probate process, the cost of this process is drastically reduced or may even be eradicated altogether.
